Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and CrewDeck, Inc., a Delaware corporation ("CrewDeck," "we," "us," or "our"). By creating an account, subscribing to a plan, or otherwise accessing or using the CrewDeck platform and related services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you are accepting these Terms on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case "you" and "your" will refer to that entity.
2. Description of Service
CrewDeck is a software-as-a-service (SaaS) platform designed specifically for roofing contractors and home exterior companies. The Service provides tools for lead management, customer relationship management (CRM), estimating and invoicing, crew scheduling, storm tracking, canvassing, commission tracking, automated communications, reporting and analytics, and other business operations functionalities as described on our website and in our product documentation.
We continuously improve and evolve the Service. Features may be added, modified, or removed over time. We will provide reasonable notice of material changes that affect your use of the Service.
3. Account Registration
To use the Service, you must create an account and provide accurate, current, and complete information. You agree to:
- Provide truthful and accurate registration information, including your real name, company name, email address, and other requested details
- Maintain and promptly update your account information to keep it accurate and current
- Maintain the confidentiality and security of your account credentials, including your password
- Accept responsibility for all activities that occur under your account, whether or not authorized by you
- Immediately notify CrewDeck of any unauthorized use of your account or any other security breach
You are responsible for managing user access within your organization. Administrators can invite, remove, and manage team members through the account settings. Each user must have their own individual login credentials and may not share accounts.
4. Subscription Plans and Billing
4.1 Plan Tiers
CrewDeck offers multiple subscription tiers: Starter, Professional, and Enterprise. Each tier includes different features, user limits, and support levels as described on our pricing page. Detailed feature comparisons are available at crewdeck.net/pricing.
4.2 Billing Cycles
Subscriptions are available on a monthly or annual billing cycle. Annual subscriptions are billed upfront for the full year at a discounted rate. Monthly subscriptions are billed on the same date each month. All prices are in US dollars and do not include applicable taxes, which will be added to your invoice where required by law.
4.3 Auto-Renewal
Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date. For monthly plans, you must cancel at least 24 hours before the next billing date. For annual plans, we will send a renewal reminder at least 30 days before your renewal date. The renewal will be charged at the then-current rate for your plan.
4.4 Cancellation
You may cancel your subscription at any time through your account billing settings. Upon cancellation, you will retain access to the Service through the end of your current paid billing period. We do not provide prorated refunds for unused portions of a billing cycle. Annual subscribers who cancel within the first 30 days of their initial subscription may request a full refund by contacting support.
4.5 Price Changes
We reserve the right to modify our pricing. For existing customers, we will provide at least 30 days' written notice before any price increase takes effect. Price changes for annual plans will apply at the next renewal.
5. Free Trial
CrewDeck offers a 14-day free trial of the Professional plan to new customers. No credit card is required to start a trial. During the trial period, you will have access to all Professional plan features with up to 5 users. At the end of the trial period, you may choose to subscribe to any paid plan. If you do not subscribe, your account will be automatically downgraded to a limited read-only state. Your data will be preserved for 30 days after the trial ends, giving you time to subscribe and regain full access.
6. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You specifically agree not to:
- Use the Service for any illegal, fraudulent, or unauthorized purpose, or in violation of any applicable local, state, national, or international law or regulation
- Upload, transmit, or distribute any viruses, malware, or other harmful code through the Service
- Attempt to gain unauthorized access to any part of the Service, other accounts, computer systems, or networks connected to the Service
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying algorithms of the Service
- Use the Service to send unsolicited bulk communications (spam) or engage in any form of abusive messaging
- Interfere with or disrupt the integrity or performance of the Service or the data contained therein
- Scrape, crawl, or use automated means to extract data from the Service beyond what is available through our official API
- Resell, sublicense, or redistribute the Service without our prior written consent
We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this provision, including suspending or terminating the offending user's account and reporting such conduct to law enforcement.
7. Data Ownership
You retain full ownership of all data, content, and materials that you or your authorized users upload, submit, or otherwise provide to the Service ("Customer Data"). CrewDeck does not claim ownership of your Customer Data. By using the Service, you grant CrewDeck a limited, non-exclusive license to process, store, and display your Customer Data solely for the purpose of providing and improving the Service.
You may export your Customer Data at any time through the export functionality available in your account settings. We support data export in standard formats including CSV and JSON. Upon termination of your account, we will provide a 30-day window for you to export your data before it is permanently deleted from our systems.
8. Intellectual Property
The Service, including its original content, features, functionality, design, source code, trademarks, logos, and documentation, is and will remain the exclusive property of CrewDeck, Inc. and its licensors. The Service is protected by copyright, trademark, trade secret, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited license to use it in accordance with these Terms.
You retain ownership of all content you create using the Service, including estimates, invoices, reports, templates, and other documents generated through your use of the platform. Any feedback, suggestions, or ideas you provide about the Service may be used by CrewDeck without obligation or compensation to you.
9. Privacy
Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in our Privacy Policy. We encourage you to review our Privacy Policy carefully.
10. Service Level Agreement
For customers on the Professional and Enterprise plans, CrewDeck commits to a service availability of 99.9% measured on a monthly basis, excluding scheduled maintenance windows. Scheduled maintenance will be announced at least 48 hours in advance and will be performed during off-peak hours (typically between 2:00 AM and 6:00 AM Central Time on Sundays).
If we fail to meet the 99.9% uptime commitment in any calendar month, affected Professional and Enterprise customers may request a service credit equal to 10% of that month's subscription fee for each full hour of downtime beyond the permitted 0.1%, up to a maximum credit of 30% of that month's fee. Service credit requests must be submitted within 30 days of the incident. This SLA does not apply to downtime caused by factors outside our reasonable control, including force majeure events, customer equipment failures, or third-party service outages.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CREWDECK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
IN NO EVENT SHALL CREWDECK'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO CREWDECK IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100). THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF CREWDECK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Indemnification
You agree to defend, indemnify, and hold harmless CrewDeck, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) your Customer Data. CrewDeck reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.
13. Termination
Either party may terminate these Terms and your account as follows:
- By You: You may terminate your account at any time by canceling your subscription through your account settings or by contacting our support team. Your access will continue through the end of your current paid billing period.
- By CrewDeck: We may suspend or terminate your account immediately if you violate these Terms, fail to pay applicable fees after reasonable notice, or if we reasonably believe your use of the Service poses a security risk to us or other users. We may also terminate your account with 30 days' written notice for any reason.
Upon termination, you will have 30 days to export your Customer Data. After this 30-day data export period, we will permanently delete your Customer Data from our active systems. Provisions of these Terms that by their nature should survive termination will survive, including Sections 7, 8, 11, 12, 15, and 16.
14. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email and by posting a notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription before the changes take effect.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Oklahoma County, Oklahoma, and you consent to the personal jurisdiction of such courts. Before initiating any legal proceedings, both parties agree to attempt to resolve any disputes through good-faith negotiations for a period of at least 30 days.
